1. Agreement to Terms
By creating an account or using Cottage Commons, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our platform.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account. By registering, you represent that you meet these requirements and that the information you provide is accurate and current.
3. The Marketplace Model
Cottage Commons is a neutral platform connecting independent cottage food sellers with buyers. We are not a food producer, retailer, or employer. All transactions are direct agreements between the buyer and the seller.
4. Seller Responsibilities & Legal Compliance
As a seller, you acknowledge that you are operating under the Colorado Cottage Foods Act. You agree to:
- Maintain all required food safety certifications.
- Ensure all products sold are non-potentially hazardous (or comply with specific refrigerated cottage food rules).
- Include the required legal disclaimer on all product labels and at the point of sale.
- Provide accurate ingredient lists, production dates, and contact information.
- Sell directly to the end consumer (no wholesale or retail consignment).
- Comply with all revenue and operational caps set by Colorado law.
You are solely responsible for determining which laws and regulations apply to your specific products and operations, and for staying current as those laws change.
5. Disclaimer of Warranties
Cottage Commons is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, secure, or error-free, or that any food listed will be safe, accurately described, or fit for consumption.
6. Limitation of Liability
Cottage Commons is not responsible for the quality, safety, or legality of food items sold, the accuracy of listings, or the ability of sellers or buyers to complete a transaction. To the fullest extent permitted by law, Cottage Commons and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the platform or any food purchased or sold through it. Any health incidents, disputes, or liabilities arising from the sale or consumption of food are the sole responsibility of the seller and buyer.
7. Indemnification
You agree to indemnify, defend, and hold harmless Cottage Commons and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the platform, the food you sell or purchase, your violation of these Terms, or your violation of any applicable law or regulation, including the Colorado Cottage Foods Act.
8. Account Suspension & Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have:
- Violated any provision of these Terms.
- Failed to comply with the Colorado Cottage Foods Act.
- Engaged in fraudulent activity or misrepresentation.
- Received consistent negative reports or safety complaints from buyers.
Termination of an account results in the immediate removal of your listings and revocation of access to our messaging platform.
9. User Conduct
You agree not to use the platform to harass others, spam users, or redirect traffic to external payment processors to bypass platform guidelines. We maintain a zero-tolerance policy for illegal or abusive behavior.
10. Governing Law & Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the platform will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of Cottage Commons after changes are posted constitutes acceptance of the revised Terms.
12. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between you and Cottage Commons regarding your use of the platform.
